  • Registered name: ZSPharm Ltd

  • Registered address: The Old Surgery, 5 Tufnell Gardens, Derby, DE22 4DY

  • Email: hello@phderby.com

  • Regulatory status: Registered under the General Pharmaceutical Council - 2220348

These Terms and Conditions (“Terms”) govern your use of this website and, where stated, the private services you book through it.

By using this website, you agree to be bound by these Terms.

2. Scope of these Terms

These Terms apply to:

  1. Your access to and use of our website and any content on it; and

  2. The process of booking private appointments with us (including via links to our clinical platform WriteUpp).

Additional terms, consent forms, clinical policies or written agreements may apply to specific services or treatments. In the event of conflict, those service-specific terms will prevail for that service.

These Terms do not override your statutory rights as a consumer under UK law.

3. Medical and emergency disclaimer

  • Information on this website is for general information only and is not a substitute for a consultation with a qualified healthcare professional.

  • We do not provide emergency medical services. If you think you or someone else may be experiencing a medical emergency, you must contact 999, attend A&E, or use NHS 111 without delay.

  • Any treatment or prescription is at the clinical discretion of the prescriber. Booking an appointment does not guarantee you will receive a particular medicine, treatment, certificate or outcome.

4. Eligibility to use our services

By using this website and/or booking an appointment, you confirm that:

  • you are at least 18 years old (or the age specified by us for a particular service);

  • you are legally capable of entering into a binding contract under the law of England and Wales; and

  • you will provide accurate, complete and truthful information about your identity, medical history, symptoms, medicines and any other details requested.

We reserve the right to refuse or discontinue services where we reasonably believe these criteria are not met, or where it would be clinically unsafe or inappropriate to proceed.

5. Bookings, cancellations and non-attendance

5.1 Booking process

  • Appointments may be booked via this website or via links that redirect you to WriteUpp, our secure clinical booking and record system.

  • Your appointment is only confirmed when you receive a booking confirmation (usually by email/SMS).

5.2 Fees and payment

  • Fees for consultations and services are shown on this website or will be confirmed during booking.

  • Unless otherwise stated, consultation fees do not include the cost of any medicines, tests or follow-up services.

  • Payment terms (including pre-payment, card charges or invoicing) will be specified during the booking process. We reserve the right to refuse or cancel bookings where payment is not made or is reversed.

5.3 Cancellations and changes

  • You may cancel or re-arrange an appointment in line with our Cancellation Policy [link or wording], which forms part of these Terms.

  • We reserve the right to charge a fee or withhold part/all of the consultation fee for late cancellations or non-attendance, as specified in that policy.

5.4 Our right to cancel

We may cancel or reschedule an appointment where:

  • the clinician is unavailable due to illness or emergency;

  • there are technical or facilities issues; or

  • it is clinically inappropriate, unsafe or unlawful to proceed.

We will make reasonable efforts to notify you and offer an alternative appointment or refund of any pre-paid consultation fee (subject to any applicable law). We are not responsible for other costs you may incur (such as travel or accommodation) unless required by law.

6. Clinical decisions, prescriptions and communication with your GP

  • Clinical decisions (including whether to prescribe, what to prescribe, and whether to continue or stop treatment) are made at the professional discretion of our clinicians, in line with relevant professional and regulatory standards.

  • We may refuse to prescribe or to continue a medicine if we consider it clinically inappropriate or unsafe.

  • With your consent, or where permitted/required by law, we may share relevant information with your NHS GP or other healthcare providers to support safe, joined-up care.

7. Website content and reliability

We take reasonable care to ensure that the information on this website is accurate and up to date, but:

  • we do not warrant that the content is complete, error-free or suitable for your particular circumstances; and

  • content may change or be updated at any time without notice.

You are responsible for how you use information on this website and should always seek specific advice from a qualified clinician before acting on any medical information.

8. Third-party links and platforms (including WriteUpp)

This website may contain links to third-party websites or platforms, including WriteUpp, payment processors or other tools.

  • These sites are operated by third parties over whom we have no control.

  • We are not responsible for their content, security, availability, privacy practices or terms of use.

When you follow a link to another site, you should read that site’s own terms and privacy policies. Your use of WriteUpp is subject both to these Terms and any applicable WriteUpp terms.

9. Intellectual property

All content on this website, including text, graphics, logos, icons, images, audio, video, layout and design, is owned by us or is used under licence.

You may:

  • view, download and print content for your personal, non-commercial use only.

You may not, without our prior written consent:

  • reproduce, distribute, modify, adapt, publish, create derivative works from, or commercially exploit any part of the website or its content; or

  • use our name, logo or branding in any way that suggests association, endorsement or approval without permission.

10. Your responsibilities and acceptable use

You agree:

  • not to use this website for any unlawful, fraudulent or harmful purpose;

  • not to attempt to gain unauthorised access to our systems or data, or to interfere with the security or operation of the website;

  • not to introduce viruses, malware or other harmful code; and

  • to keep any login or account details (if applicable) confidential and not to share them with anyone else.

We may suspend, restrict or terminate your access to the website if we reasonably believe you have breached these Terms or pose a security or misuse risk.

11. Data protection and confidentiality

We process personal data in accordance with UK data protection law and our Privacy Policy, which forms part of these Terms and can be found here: Privacy Policy

By using this website or booking services, you acknowledge that you have read and understood our Privacy Policy.

Clinical information is handled in line with professional confidentiality and record-keeping standards, and stored securely within our clinical systems (including WriteUpp).

12. Limitation of liability

Nothing in these Terms excludes or limits our liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation; or

  • any other liability which cannot be excluded or limited under applicable law.

To the fullest extent permitted by law:

  • we exclude all implied conditions, warranties, representations or other terms that may apply to this website or any content on it;

  • we will not be liable for any loss or damage arising from your use of, or inability to use, this website, or reliance on any content displayed on it, where such loss or damage is indirect, consequential, or relates to loss of profit, revenue, business or goodwill; and

  • in relation to non-clinical services provided via the website (such as booking), our total aggregate liability to you in respect of any claim, whether in contract, tort (including negligence) or otherwise, shall be limited to the total amount paid by you to us for the relevant service in the 12 months preceding the event giving rise to the claim.

Separate standards and duties apply to the provision of clinical care and are not restricted by this clause where such restriction would be unlawful.

13. Suspension and termination

We may suspend or terminate your access to the website, or the provision of non-clinical services, where:

  • you materially breach these Terms;

  • we are required to do so by law, regulator or court; or

  • it is necessary for security, maintenance or operational reasons.

Where practicable, we will provide reasonable notice, but we may act without notice where urgent or required by law.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in law, regulation, clinical guidance or how we operate.

  • The updated Terms will be posted on this page with a new “Last updated” date.

  • Your continued use of the website after changes take effect will constitute your acceptance of the updated Terms.

If a change materially affects your booked services, we will take reasonable steps to notify you.

15. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction, except that consumers resident in other parts of the UK may also bring claims in their local courts where required by consumer law.
